SAMPLE AGREEMENT

This is a basic sample template of the agreement you'll be sent once everything's been worked out for your commission.  There will be minor changes here and there, and if you intend to sell the image yourself there will also be a licensing agreement listed in the contract.  Otherwise, this is about what it should look like!

The client ([name], [email] 'client') has contracted the artist (H.A. Littlejohn, nashidesei@gmail.com, 'artist') to design and complete [description of commission] ('project', 'drawing' 'image').

These drawings are to be drawn in accordance with the quality of a [commission type], as featured in the examples on the commissions page of the Near a Tree website (http://www.nearatree.com/commissions.html).  The total fee of the project amounts to [price] USD.  In agreement with the artist's payment plan [see below] ...

For commissions priced over $40.00: ... 50% of the agreed total fee is to be transferred via [payment method], prior to any work being done on the project.  The other 50% is to be transferred upon completion of the project.  (In other words, [half price] is to be paid upon agreement to these terms, with another [half price] transferred when all work is finished.)

The artist agrees to begin work on the project as soon as payment has been received, and to complete all images within the space of [timeframe].

The completed drawings are to be used for display by the client, or for the purpose of graphics, headers, icons, banners, and other digital media.  They are not to be used for merchandising or any other marketing endeavor, and remain the intellectual property of the artist.  If the project is to be used for some commercial means at a later date, a secondary licensing fee and/or royalty rate must be agreed upon by both parties.

This agreement is accepted by both parties, and should be printed for recording purposes.
